Terms of Use — LitArbi Alpha

1. Scope and provider
These terms govern the use of the LitArbi software (macOS app including the Word add-in) within the alpha programme and the litarbi.app website. The provider is GameBanAppeal UG (haftungsbeschränkt), Mittelstraße 11, 40789 Monheim am Rhein, Germany ("we").
2. Alpha programme
- LitArbi is at an early stage of development (alpha). Participation is free of charge and serves to test the software.
- There is no entitlement to participation, availability, particular features or freedom from defects. We may modify, suspend or end the programme and revoke licences at any time.
- Alpha software can contain bugs. Work on copies of your documents and back up your data regularly (e.g. via "Export Matter").
3. Licence
- For the duration of the alpha programme we grant you a simple, non-transferable, non-sublicensable right to use LitArbi on up to two Macs used by you, for testing purposes.
- Licence keys are personal and must not be shared.
- Decompilation and reverse engineering are prohibited except to the extent mandatorily permitted by Sections 69d, 69e of the German Copyright Act.
4. System requirements
macOS 14 or later (Apple Silicon or Intel); for the Word integration, Microsoft Word for Mac version 16 or later (Microsoft 365 or Word 2021/2019). A Windows version is planned but not currently part of the programme.
5. Your data, your responsibility
LitArbi processes your documents locally (see the privacy policy). You remain responsible for compliance with your professional duties (e.g. confidentiality, review of submissions before filing). LitArbi is a tool and does not provide legal advice.
6. Feedback
If you send us feedback, bug reports or suggestions, we may use them to improve the software without restriction in time or territory.
7. Warranty and liability
- The software is provided free of charge. Warranty and liability therefore follow the statutory standards for gratuitous provision: we are liable only for intent and gross negligence and for fraudulently concealed defects.
- Liability for injury to life, body or health and under the German Product Liability Act remains unaffected.
- For loss of data we are otherwise liable only up to the effort that would have been required for recovery had proper, regular backups been made.
8. Term and termination
This agreement runs for the duration of the alpha programme; either side may end it at any time. On termination the licence lapses — your work product (matters, bundles, submissions) of course remains yours.
9. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- If the user is a merchant, the courts at the company's seat have jurisdiction.
- Should individual provisions be invalid, the remaining provisions remain unaffected.
